Terms of Service.

01The agreement

A quick handshake before we start.

These Terms of Service ("Terms") form a binding agreement between you ("User", "you") and Cricverse SportsTech Pvt Ltd, a company incorporated in India ("Swing", "we", "us"). They apply when you download, install, access or use any of our sports ecosystem apps, Swing Player, Swing Biz, Swing Live, the website at swingcricketapp.com, our APIs, the IP Points loyalty programme, or any other Swing product or service (together, the "Service").

By creating an account, signing in, or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you don't agree, please don't use the Service.

02Definitions

Sport has its own vocabulary, so do these Terms.

Account

Your personal Swing identity, used across Player, Biz and Live.

Player

An individual athlete using Swing Player to track matches, training and stats across supported sports.

Organiser

An academy, club, league, tournament owner or facility using Swing Biz.

Scorer

A user, official or volunteer, recording match data via Swing Live.

Match Data

Scorecards, play-by-play records, videos, stats and derived metrics for any match, game or event scored on Swing.

Content

Anything you submit, upload, post, score, stream or share via the Service.

IP Points

Loyalty credits issued under our rewards programme. Not currency; not transferable except as expressly permitted.

03Your account

Eligibility

You must be at least 13 years old to create an Account. Users between 13 and 17 must have a parent, guardian or registered coach who has agreed to these Terms on their behalf. Some features (e.g. monetary withdrawals from IP Points) require you to be 18 or older and to complete additional verification.

Registration

You agree to provide accurate, current and complete information when you sign up, and to keep that information updated, particularly your match-eligible age, role, club and contact details. Misrepresenting your identity, age, statistics, or affiliations is a material breach of these Terms.

Security

You're responsible for keeping your login credentials confidential and for all activity that happens under your Account. Notify us immediately at security@swingcricketapp.com if you believe your Account has been compromised.

04Using Swing

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal sporting activity or, where you're an Organiser, your organisation's sports operations.

• Player is for individual athletes, parents and family supporters tracking real sports activity.
• Biz is for verified Organisers running real academies, clubs, tournaments or facilities.
• Live is for officials, scorers and broadcasters scoring real matches in real time.

You may not resell, sublicense, rent, lease or commercially redistribute the Service or any part of it without our prior written consent.

05Your content & data

You own what you upload

You retain all rights you have in your Content. You don't sign over your name, your stats, your match videos, or your image to us.

Licence you grant us

To run the Service, you grant Swing a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, adapt, distribute and transmit your Content solely as necessary to: (a) provide and improve the Service to you and to other authorised users (e.g. teammates, opponents, scorers, organisers); (b) generate aggregated and de-identified statistics; (c) syndicate scorecards and match summaries to broadcast partners where you've consented; and (d) comply with legal obligations.

Match Data, shared by nature

Sport is played in shared settings. Match Data captured during a match, game or event (scorecards, play-by-play records, outcomes, clips and derived statistics) is made visible to other participants in the same activity and may appear on public match pages where the Organiser has chosen to publish them. You can control your profile-level visibility in Settings; you can't retroactively erase match-level history without breaking shared records.

06Scoring & statistics

Swing Live is the source of truth for matches scored on Swing. We work hard to keep scoring accurate, but:

• Final results, scorecards, dismissals and umpiring decisions are determined by the on-field umpires and the appointed scorer, not by Swing.
• If a match is rescored, voided or amended by the relevant Organiser or governing body, derived statistics (averages, strike rates, IP Points, leaderboards) will be re-computed.
• Where stats power monetary outcomes (prize pools, contracts, sponsorship triggers), Organisers must independently verify Match Data before relying on it.

07Payments & subscriptions

Free & paid plans

Most of Swing Player is free. Swing Biz and parts of Swing Live are sold as monthly or annual subscriptions. Prices are shown in-app and on the website in the local currency where supported, and exclusive of taxes unless stated otherwise.

Billing

Subscriptions auto-renew at the end of each billing cycle until cancelled. You can cancel any time from your Account settings; cancellation stops future renewals but does not entitle you to a refund of the current period unless required by law.

Refunds

We offer a 7-day refund window from first paid subscription on Swing Biz, no questions asked. Beyond that, refunds are at our discretion. App-store purchases (Apple, Google) are governed by the relevant store's refund rules, please contact them first.

08IP Points programme

IP Points are loyalty credits earned for sporting activity (matches played, milestones, tournaments, partner rewards). They are not currency, not investments, and have no cash value except where we explicitly enable redemption with a verified partner.

• Points are personal and may not be sold, transferred or pooled except via official Swing programmes (e.g. team kit redemption).
• We may adjust earn rates, redemption catalogues and expiry rules with reasonable notice.
• Points obtained through fraud, bot activity, misrepresented matches, or scoring abuse will be revoked, and the Account suspended.

09Prohibited conduct

You agree not to:

• Falsify Match Data, invent matches, ghost players, fabricate stats, or score matches that didn't happen.
• Impersonate another athlete, coach, scorer or organiser, or misrepresent your affiliation with any club, academy, league or governing body.
• Harass, threaten, dox, racially or sexually abuse another user, on chat, comment threads, or anywhere else on the Service.
• Reverse-engineer, scrape, mirror, or access the Service or our APIs other than through the means we provide.
• Upload malware, attempt to gain unauthorised access to other accounts, or interfere with the integrity or performance of the Service.
• Use the Service for gambling, betting markets, fantasy contests, or any unlawful purpose.

10Intellectual property

The Service, including its design, software, logos, the "Swing" wordmark, the batsman mark, all UI artwork, copy, and our compiled statistics database, is owned by Swing or its licensors and is protected by copyright, trademark, database rights and other laws. Nothing in these Terms transfers any of those rights to you.

You may not use Swing's name, logos or brand assets without prior written consent, except for fair, factual reference (e.g. "We use Swing for scoring").

11Third-party services

The Service integrates with third parties, Apple App Store, Google Play, payment processors (Razorpay, Stripe), mapping providers, broadcast partners, video CDNs, and others. Your use of those services is governed by their own terms; we're not responsible for them. Where we share data with a third-party processor, we do so under a data-processing agreement and only for the purposes set out in our Privacy Policy.

12Suspension & termination

You can delete your Account at any time from Settings → Account → Delete. We can suspend or terminate your Account, with or without notice, if we reasonably believe you've breached these Terms, harmed other users, or put the Service at risk. We'll let you know why where it's safe and lawful to do so.

On termination: your licence to use the Service ends; we may anonymise or delete your Content according to our retention policy; Match Data already part of public scorecards stays in the historical record.

13Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, Swing disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, secure, or that any Match Data is complete or correct.

Sport involves physical activity. Swing is a tool; it does not coach, supervise, or take responsibility for the safety of players, officials or spectators. Always follow your governing body's rules and use proper protective equipment.

14Limitation of liability

To the maximum extent permitted by law, Swing's aggregate liability arising out of or relating to the Service in any 12-month period is capped at the greater of: (a) the amount you paid us in that period; or (b) ₹10,000 (or local equivalent). We're not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, or goodwill.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for fraud, gross negligence, death or personal injury caused by negligence.

15Disputes & governing law

These Terms are governed by the laws of India, excluding its conflict-of-laws rules. The courts at Bhopal, Madhya Pradesh have exclusive jurisdiction over any dispute, except that we may seek injunctive relief in any competent court to protect our intellectual property or platform integrity.

Before filing a dispute, please contact us at legal@swingcricketapp.com, we genuinely try to resolve issues directly.

16Changes to these terms

We may update these Terms from time to time. If the change is material, we'll notify you in-app or by email at least 14 days before it takes effect, and we'll publish the prior version at /legal/archive. Continued use after the effective date means you accept the updated Terms; if you don't agree, please stop using the Service and delete your Account.

Minor non-material edits (typos, formatting, broken links) take effect immediately and are noted in the version history below.
